Data transfers to third countries (USA)

When Google services are used, personal data may be transferred to Google LLC in the USA. According to its own statements, Google LLC is certified under the EU-US Data Privacy Framework (DPF), which was recognised by the European Commission in an adequacy decision of July 2023 and upheld by the General Court of the EU in September 2025 (Case T-553/23).

Important notice on the current status (October 2026)

An appeal against the judgment of the General Court is pending before the Court of Justice of the European Union (CJEU) (Case C-703/25 P, Latombe v Commission); it has not yet been decided. In addition, following a judgment of the US Supreme Court of 29 June 2026 (Trump v. Slaughter) on the independence of the US Federal Trade Commission (FTC), the validity of the adequacy decision is being publicly questioned: the privacy organisation noyb has called on the European Commission to withdraw it and has announced a further legal challenge. The CJEU declared the two predecessor arrangements (Safe Harbor, Privacy Shield) invalid in each case. The current adequacy decision is valid and applicable for the time being, but further legal developments should be monitored. Where DPF protection does not apply, the transfer takes place, in the alternative, on the basis of EU Standard Contractual Clauses (Art. 46 GDPR).
